Plaintiff-appellee Tyger Construction Company, Inc. ("Tyger") instituted this breach of contract action on December 12, 1988 in the United States District Court for the Eastern District of Virginia against defendant-appellant Pensacola Construction Co. ("Pensacola"). The complaint alleged that Pensacola had breached the joint venture agreement ("the Agreement") between the parties by failing to make a capital contribution to the joint venture as required by the Agreement. The district court granted Tygers motion for summary judgment, and Pensacola appeals. We affirm.
